This being the case we suppose Obama has to do something to appease his radical left base (who are even turning on him in some cases), however this is quite a position for him to take. A major flip-flop. He defended it as constitutional before he decided it is unconstitutional. You could say he’s having a “a John Kerry moment”!

On another note, that’s fine, you refuse to enforce this, just like all over the country there are refusals to implement some of you law, ie. obamacare, but make no mistake – there is one big difference. With obamacare, we didn’t just decide one day that it’s unconstitutional, we held that from day one. The difference between principles and political expediency!

Now a man Jeremy Bernard has been appointed to the post of White House social secretary, but the Administration and MSM seek to further another stereotype by making a big deal over the first male in the post being openly gay.

Defense of Marriage Act, ObamaCare and Kagan

President Obama’s decision today to abandon the Defense of Marriage Act (DOMA) is both outrageous—as a matter of Justice Department policy and constitutional law—and a miscalculation that will decreases the chances of ObamaCare being implemented, while potentially increasing calls for Supreme Court Justice Kagan to recuse herself from certain gay rights cases.

The President’s refusal to defend DOMA, a federal statute enacted by overwhelming margins in the Senate (85 – 14) and House (342 – 67) and signed into law by President Clinton, flies in the face of Justice Department policy and principles of democratic government. It has long been the Department’s policy to defend any challenged federal statute unless no plausible argument can be made in its defense. By ignoring that policy, President Obama is engaging in a disturbing power grab that, if taken to its logical conclusion, would allow him to undermine any duly enacted federal law that he doesn’t personally agree with.

But that’s not the worst of this power grab…

New Yorkers for Constitutional Freedoms Denounces President Obama’s Refusal to Defend Marriage and America’s Laws

ROCHESTER, NY – 02/23/2011 – Today President Obama ordered the US Department of Justice to cease defending the federal Defense of Marriage Act (DOMA). New Yorkers for Constitutional Freedoms responded to President Obama’s egregious action with the following:

“It truly is a sad day when the President of the United States refuses to defend America’s laws,” said Rev. Jason J. McGuire, Executive Director, New Yorkers for Constitutional Freedoms.

DOMA is the US law that for federal purposes defines marriage as a union between one man and one woman. In a bi-partisan fashion, DOMA was passed in 1996 and signed into law by then President Clinton. The law upholds a state’s individual right to refuse recognition of same-sex “marriages” performed in other states.

McGuire believes, “If there is a silver lining to be had in the fact that the President will not support established law, it is that at least the path is cleared for Speaker John Boehner and House Republicans to intervene and defend the interests of a majority of Americans.” 

New Yorkers for Constitutional Freedoms remains committed to defending marriage at both the state and federal level.
