Now that we have irrefutable evidence that Jared Lee Loughner wasn’t inspired to his horrific act of violence last week by the tea parties, Sarah Palin or Rush Limbaugh, we’ve assembled some simple rules for liberals to follow in the future, so they don’t actually get someone shot themselves with their irresponsible charges.

Granted, some on the left seem to want Sarah Palin dead, if you can believe the tweets and comments on the Daily Kos and Media Matters, but we will assume that a few hundred wingnuts don’t represent the vast majority of lost souls who call themselves progressives. You will notice, however, that Hot Air and Big Government and The Daily Caller posts aren’t burning up with threats from conservatives who wish Barack Obama or Nancy Pelosi harm. We don’t wish them harm; we wish them retired.

First, conservatives don’t point their guns at anyone who isn’t pointing one at them. This was best demonstrated historically at the O.K. Corral, where four loudmouthed Democrats given to making outrageous charges drew their guns on the Republican Earp brothers. The Earps won. Of course they had one pro-gun Blue Dog with them, Doc Holliday, but the fight was fair. Check my history here, but I think that was the last time a Democrat ever got on the right side anything.

Secondly, pro-gun conservatives don’t make idle threats. If you’ve been warned it is because you are dangerous to someone. We don’t brandish our guns and yell a whole lot; it doesn’t accomplish anything. Generally a conservative is more apt to back you in the corner for a good bitch slapping rather than shoot you. Ammunition is expensive.

Third, a pro-gun conservative may have a weapon at any time, regardless of liberal municipal ordinances—call it a weakness—but he or she will never point it at a public official or an innocent citizen. Worry if you are an armed rapist, mugger, home invader or loony tune out to wreak havoc on innocent citizens, otherwise you are safe.

Last, and this is important, pro-gun conservatives understand the limitations of the Second Amendment. If you see a gate around one of our yards, it is usually not there to keep intruders out; it is there to keep them in until the police take them away. Of course, there are those unfortunate times when an intruder brings a gun to a conservative’s home, but we cannot be responsible for everyone.

In spite of a complete lack of evidence and contrary to history, liberals have for years waited for unfortunate opportunities to level baseless charges at conservatives, when quite the contrary has been the case. A pro-Castro communist assassinated JFK, Robert Kennedy was murdered by a Palestinian terrorist, and Harry Truman’s attackers were Puerto Rican rebels.

John Hinckley was a deranged Jodie Foster fan; Squeaky Fromm and Sara Jane Moore, who each attempted to assassinate Gerald Ford were, respectively, a Manson Family member and whack job. Each one of these individuals can be accurately described as a liberal.

When are you guys going to get it right? We don’t shoot politicians, you do.

The Arizona Shootings, Gun Violence Research and the Facts vs. The New York Times

You know you’re doing something right when two New York Times columnists, Gail Collins and Nicholas Kristof, attack your research on the same day. Kristof followed up on criticism leveled earlier in the week by others writing for The Times. I must have said something substantial enough to warrant this attention. Let us check the facts. Gail Collins worries that law-abiding citizens carrying concealed handguns can’t be trusted:

“One can only hope that Saturday’s horrible attack in Tucson encourages more citizens to carry concealed handguns,” wrote John Lott, Jr. . . . on Wednesday. As a model, he pointed to Joseph Zamudio, . . . Lott’s theory was that Zamudio was able to lend a hand “because his legally carried 9 mm semiautomatice offered him protection.” He neglected to mention that while Zamudio never fired at the gunman, he almost drew on an innocent man by mistake.

No, it was not my mere speculation. Zamudio himself told Fox News’ “Fox & Friends” that he though that carrying a gun made him willing to run towards the shots while almost everyone else was running for cover. As to the possibility of shooting an innocent man, that possibility didn’t occur because Zamudio used caution and observed from the gun’s slide that it was out of bullets. While gun control advocates like to view his composure as extraordinary, it actually happens again and again.

Of all the multiple victim shootings around the country in public schools, the Appalachian Law School, on city streets, churches, or in malls that have been stopped law-abiding citizens with concealed handguns, none, not a single one has resulted in innocent bystanders being shot. Indeed, rarely do the citizens with the concealed handguns actually pull the trigger, simply brandishing the gun stops the attack. Permit holders do not endanger others.

Take Arizona, since that is where all the focus is. As of December 1, 2007, there were 99,370 active permits. During 2007, 33 permits were revoked for any reason — a 0.03% rate — cases that did not involve using the gun to harm others. And this is true in state after state. Between October 1, 1987 and December 31, 2010, Florida issued permits to 1.9 million people. 168 permit holders had their permits revoked for any firearms related violation, a rate of 0.009%.

Some writers — Mr. Kristof as well as earlier pieces by John Donohue and James Alan Fox from Tuesday’s New York Times website — argue that the academic literature disagrees with the my claim that concealed handguns deter crime.

Kristof wrote: “One scholar, John Lott Jr., published a book suggesting that more guns lead to less crime, but many studies have now debunked that finding (although it’s also true that a boom in concealed weapons didn’t lead to the bloodbath that liberals had forecast).”

And John Donohue claimed: “while some early studies by John Lott and others suggested that state policies providing greater freedom to carry guns would reduce crime, empirical evidence refutes this view.”

When my original findings were published in the mid-nineties, there was a widely held belief that right-to-carry laws could result in blood baths and see increased deaths. Ample empirical evidence has shown this not to be the case. The debate is rather over whether there is no effect, a small benefit, or a large benefit.

Despite the above assertions, most of the academic research, including recent research on right-to-carry research by economists and criminologists do indeed show that the laws reduce violent crime (see the table here from the third edition of “More Guns, Less Crime“).

Among peer reviewed studies in academic journals, 16 studies examining national data find that right-to-carry laws reduced violent crime, 10 claimed that they found no discernible effect, and zero studies found a bad effect from the law. Five other non-refereed studies were more divided, with three finding drops in crime, one claiming to find no effect, and two saying that there were either no effect or possibly small increases in crime. But even “no discernible effect” is usually not the same as “debunking” or “refuting” a hypothesis. Rather it often means that the evidence is not sufficient to draw a conclusion.

Both Kristof and Donohue link to a paper by Ayres and Donohue that supposedly “debunks” my research. That is hardly true. Even if we were to fully accept the wording of the research paper, which is questionable, they claim to have found a small temporary initial rise in crime, followed by a long sustained drop. Yet, even the initial increase is a result of a mistake in how they set up their regressions and even their own more precise estimates of the yearly changes in crime never show that increase.

James Fox points to research on multiple victim public shootings: “criminologists Grant Duwe, Tomislav Kovandzic, and Carlisle Moody [that] found the effect of various right to carry laws on the incidence of public mass shootings to be negligible.” Alas, unlike my own work with William Landes, the research restrict their sample to attacks where four or more people were killed. These cases are sufficiently rare that one cannot expect to find anything from such a small sample. Landes and I found significant results when we examined more common cases where three or more people killed or four or more people killed or injured.

It is flattering to have the New York Times spend so much space discussing my work this week (and even CNN got into the discussion), but it would be even better if The Times could accurately report on the debate.

Republican Peter King’s Loony Gun Law

This is one for all of you Republican out there to think about. GOP Congressman from New York, Peter King, is drafting legislation to outlaw carrying a gun near certain public officials.

According to Fox News, King said his bill would make it illegal to knowingly carry a gun within a thousand feet of “certain high-profile” government officials.

That’ll fix it.

Have you thought about it? Okay, does anyone actually believe that Jared Loughner or any other bag of nuts and bolts who wants to assassinate a U.S. Congressman or Senator really gives a flying Georgetown doo-doo what the law says?

Tell me the truth Republicans. Did you guys actually elect this guy? Mario Cuomo appointed him when he was governor, right? And you think Sarah Palin is stupid?

With the parlor games going on in the Democratic Party right now, the country has quite enough to contend with, without a Republican introducing another needless loony piece of legislation that no one serious about committing a felony will care about one way or another. They have James Clyburn, you guys have Peter King and Dan Burton, that it? If King wants to draft a new bill, how about one that prevents any member of Congress from sending out any propaganda material capitalizing on a national crisis?

Seriously, in the wake of the first Kennedy assassination Congress passed a litany of gun laws. Have murders diminished? Have bank robbery statistics improved? How about assassinations and attempted assassinations, kidnappings, rapes? Not a bit. So what is the end game here, other than to take firearms away from citizens?

America will never give up her guns. The vast majority of gun owners would never think of committing a crime, so laws like King’s are ludicrous.

Public servants should be assured of protection when they are performing their duties for the people of their states, and that protection was available to Representative Giffords upon request by local law enforcement. It is probably is not an appropriate time to say it, but Congress hasn’t taken a moment’s pause before capitalizing on the moment, so neither will I; either Congresswoman Giffords or the Pima County Sheriff’s were negligent in scheduling this event.

We have heard that the Congresswoman was concerned for her safety after the Tea Party events last summer; her father said the whole Tea Party were her enemies. So why did her staff not schedule security for the event?

Memo to Representative King: Get freaking serious: your state is buried in debt, health care is in shambles, immigration is out of hand, and millions are jobless. Pick a topic and do something useful.

Gregory Girard’s Worst Nightmare Comes True

Gregory Girard is an telecommunications consultant who lives in Manchester-by-the-Sea Massachusetts. Over the last few years, Greg has become increasingly worried that the U.S. government would start ignoring citizens Constitutional rights, confiscate their firearms in illegal raids, and imprison them without charges.

To protect the his Constitutional rights, and the Constitutional rights of all Americans, Greg started to prepare for the dark days which he foresaw as a very real possibility. He legally purchased firearms and other weapons, along with food and medical supplies.

This prompted the local, state, and federal police to conduct an illegal raid on Gregory’s house, confiscate his legal property, and imprison him without charges. On 9 February Greg’s home was raided, his supplies were confiscated, and he was dragged off to jail.

The state has been forced to drop most of the charges against Girard, but they are still holding him without bail — hoping to invent some new crime with which to charge him.

Police have moronically claimed that the batons Greg owns are “illegally” acquired, even though they can be purchased from many stores by any private citizen. The police have also referred to a metal plate that Greg owns as an “illegal ballistic plate” — as if there is some new law against metal plates. A police spokesman also stated “”We feel our community is safer having this kind of weaponry off the street”, implying that Greg was wandering down the street with his survival supplies.

The ineptitude of the prosecution includes:

  • Mistaking legal smoke generators as hand grenades.
  • Mistaking legal flash suppressors for firearm silencers.
  • Charging Greg with “carrying dangerous weapons”, even though Greg didn’t carry any of these weapons outside his home.

The government has been made to understand their mistakes on the issues of the “hand grenades” and the issue of “carrying” weapons. They are still too rock stupid to understand the different between a flash suppressor and a silencer.

Firing a weapon inside one’s own home isn’t even a criminal offense in Massachusetts — but Greg is still being held without bail. He’s being imprisoned purely for his political beliefs. In addition, Greg’s license to carry a firearm was revoked — even though he has not been convicted of any crime.

From this point of view, Greg’s worry that the U.S. government will start ignoring citizens Constitutional rights, begin confiscating their firearms in illegal raids, and carelessly imprison citizens without charges seems pretty reasonable.

If this can happen to a upstanding citizen in suburban Massachusetts, it can happen to any of us.  Without the protection of the United States Constitution, there is nothing to protect us from government depredation.  The government seems more than willing to completely ignore the Constitution.  What will we do to stop them?  What will you do to protect your Constitutional rights?

Obama Administration Blocks Sale of Surplus Korean War RiflesThe Obama administration has moved to block the sale of 857,470 Korean War vintage rifles. The rifles were previously approved for sale from the South Korean government to American citizens, but the Obama administration yanked back approval without explanation.

The rifles consist of 770,160 M1 Carbines and 87,310 M1 Garand rifles.  These rifles are fifty years old and are technically “curios and relics”, but they are still fine pieces of equipment which can be used in hunting deer and other wild game.

The rifles are also important pieces of history.  These weapons were used by American soldiers to protect South Korea from the Red Chinese.  These rifles are fairly rare in the United States and should be preserved as an important part of our national heritage.

These rifles are semi-automatic and are full legal in the United States.  The Obama administration is exploiting a loophole in the law which allows them to ban these rifles due to their previous ownership.  The South Korean government sold 200,000 of these rifles in the United States in 1987 and those rifles have served Americans well for more than two decades.

This appears to be one more step by the Democrats to make affordable firearms unavailable — effectively implementing gun control on everyone but the wealthy. The administration is refusing to comment on this gun ban — yet another example of how Barack Obama has created one of the least transparent administrations in American history.

There is something about living in the wide open spaces of Montana which seems to lead men to understand the true nature of freedom more easily than those individuals who live in the crowded urban  jungles of our Eastern seaboard.

The folks in Montana may have created a real problem for themselves this time. The state of Montana has signed an act into law which is purely constitutional, and by being so flies in the face of eighty years of tyrannical behavior by the federal government. As Voltaire wrote in 1764, “It is dangerous to be right when the government is wrong.”  The good people of Montana may soon discover how true that still is.

The Bill in question is the Montana Firearms Freedom Act.  This act explicitly exempts the territory of the State of Montana from the federal governments abusive misinterpretation of the Commerce Clause of the United States Constitution.

The Commerce Clause, Article I, Section 8, Clause 3, reads:

You couldn’t be more wrong.

Just following the rules could land you in prison! Despite the legislative victories of the last election, the anti-gunners and statists across the country are finding new ways to violate your rights.

In August, Brian Aitken — who followed New Jersey’s draconian firearm laws to a “T” — was convicted by the state’s anti-gun kangaroo court of “unlawful possession of a handgun.”

Brian’s “crime” was simply owning handguns in the first place.

You see, in New Jersey you’re required to get a permit to purchase a handgun by Big Brother State Government. This is not a permit to OWN, simply to purchase: however, the jackboots in New Jersey’s state police treat anyone in possession of a handgun without such a permit as a felon.

While moving from Colorado to New Jersey, Brian was transporting three handguns — which were legally purchased in Colorado — between his mother’s house and his new apartment.

Because of some stress factors in his life, Brian’s mother called the police for a “welfare” check of Brian. Brian’s mother was a social worker who had been conditioned by years of government work to trust the state to oversee emotionally charged situations.

The state police searched his car and discovered the handguns, locked in cases and separate from ammunition, as New Jersey law requires.

Despite not violating ANY of New Jersey’s outrageous firearms laws, Brian was arrested for the “unlawful” possession of a handgun.

Throughout his trial, the anti-gun statists in the New Jersey legal system routinely blocked Brian’s attorney from presenting evidence of Brian’s innocence. New Jersey law specifically states that the transportation of handguns between residences is legal.

Despite the incontrovertible evidence that Brian was transporting his legally purchased handguns from his mother’s home to his new apartment, the anti-gun Judge refused to permit Brian’s legal team from informing the jury of this portion of state law.

Jurors even asked the judge three times if state law contained exemptions for the transportation of handguns from one residence to another, but the anti-gun crusader disguised as a judge refused to answer.

Additionally, federal law allows for the transportation of firearms between residences without fear of state prosecution; however, the same anti-gun judge refused to take federal law into consideration in Brian’s case.

Brian Aitken was convicted of felony possession of a handgun and faces up to seven years in jail.

Think you’re safe ’cause you live in a “pro-gun” state? Think again.


Expect to hear statists across the country calling for increased enforcement of “existing” gun law.

That’s code for twisting current law to maliciously prosecute gun owners, and it’s nothing new: the institutional gun lobby has been promoting this for more than a decade.

State and local governments will respond to this anti-gun cattle call and will race to create new ways to infringe upon your rights through bureaucratic fiat and “rule” changes.

That’s exactly what happened in New Jersey and an innocent man was convicted simply because he owned guns.

If you’re as outraged about this case as I am, there are a couple of things you can do.

Click here to sign a petition to New Jersey’s Republican Governor Chris Christie and urge him to pardon Brian Aitken and publicly call for the repeal of New Jersey’s current law requiring a permit to own a firearm. Governor Christie has national political ambitions and this case will clearly show what he thinks about the Second Amendment.

Brian Aitken’s prosecution and conviction is simply outrageous and it’s a cautionary tale to all gun owners.

Anti-gunners will stop at nothing — and I mean NOTHING — to put law-abiding gun owners behind bars.

President Obama has nominated an anti-gun zealot Andrew Traver to be the next director of the Bureau of Alcohol, Tobacco, Firearms and Explosives (BATFE).

This nomination comes shortly after Sarah Brady’s anti-gun cabal publicly scolded the President for saying “as little as possible about the plague of gun violence…” In anticipation of his re-election campaign, Obama is working to pay off the anti-gun lobby.

Traver is on record as opposing private firearms sales, gun shows, and the civilian ownership of semi-automatic rifles. Traver clearly has an anti-gun agenda in step with anti-gun radicals like Sarah Brady, Chuck Schumer and President Obama himself.

Let me give you Andrew Traver’s philosophical resume:


  • He favors banning ALL gun shows.
  • He opposes civilian ownership of semi-automatic rifles and shotguns.
  • He opposes private firearm sales.
  • He wants the Center for Disease Control to have oversight of the firearms industry. Apparently Mr. Traver believes guns are a disease. Or, maybe it’s the gun owners he believes are diseased.
This is a DIRECT AFFRONT to those of us who own guns and use them properly and lawfully.
A frightening as it is, Mr. Obama can legally make a “recess appointment” and commission Mr. Traver is the TOP law enforcement official over the gun industry without a single Senator voting to confirm him. By confirming him on January 1, 2011, Traver would head the ATF for the balance of Obama’s term in office. Now, that’s scary, too. Your fax and your Donation can help to delay this appointment. That’s why I am writing this URGENT EMAIL today. We must make a difference against this outrageous affront to you and me who are gun-owners. Will you help us—and assist America—today?
The ATF hasn’t has a director for almost four years. Former director Carl Truscott’s reign was marked by numerous complaints about misappropriation of funds and poor treatment of employees. Following his resignation in 2006, the parameters were changed, and Senate confirmation is now required for a nominee.

Mr. Traver is NOT a friend of the people who whole-heartedly believe in the Second Amendment rights in the U. S. Constitution. Yes, that’s you and me!

What he is a “friend” of is the “Chicago Machine” that spawned so many of your favorite Chicago-Washington “elites” who use the word “Chicago” as a synonym for cronyism. Cronyism was voted OUT in the November elections; but the message has not yet resonated at 1600 Pennsylvania Avenue. Obama’s anti-gun friend will head the ATF if the American people don’t stop him. That’s why you and I must FAX every Member of Congress to STOP this recess appointment.

The bottom line: We MUST let our voices and votes be heard. Traver is obviously NOT the man to head the most powerful firearms policing agency. His ANTI-GUN BIAS illustrates a clear conflict of interest on his part and his nomination proves that Barack Obama is openly hostile to your gun rights.

Anyone as clearly hostile to the Second Amendment as Mr. Traver is, has no business being allowed to head the powerful gun licensing and regulatory agency.

The nomination of the Naperville, Illinois native to be top gun cop is applauded by gun-control activists, who say the 5,000-employee ATF has lost ground in its regulation of the $28 Billion US firearms business, having labored under interim directors since 2006.

Quite frankly, Mr. Obama has chosen a very strong, anti-Second Amendment ATF head for an administrative job that has far more influence over the practical exercise of the Second Amendment rights than any other job in the country.

In spite of our economic uncertainty, Americans spent $11 BILLION MORE in 2009 than in 2008 to buy guns, ammo, and gear, etc. In an economy that needs every dollar in retail sales from every corner of the free enterprise system, killing $11 billion more in retail sales in a failing economy is not wise, the Second Amendment notwithstanding.

There are roughly 80,000,000 gun owners in our great country who like you, must reject this presidential appointment. So we must GET INVOLVED NOW to fax every single Member of Congress to make sure that the appointment of Andrew Traver is TOTALLY BLOCKED.

Chris Cox, NRA spokesperson said this about Andrew Travers: “You might as well put an arsonist in charge of the fire department.”

The bottom line: Andrew Traver is an anti-gun zealot. His confirmation, recess or otherwise, MUST be blocked! Mr. Traver is clearly NOT the man to head the most powerful firearms policing agency in the world. His anti-gun bias illustrates a clear conflict of interest. Please help us at this very moment to block this travesty and adverse person who is AGAINST YOU and your ownership of a gun.
